Please read before requesting a service from us. These terms and conditions apply to “the website” www.fitbodypromotions.com; use of the website also binds you the ‘user & client’ by these terms and conditions. The following terms describe the terms under which Fit Body Promotions Ltd (“the company” or “we”) offers you access to its services. If you would like to become a Fit Body Promotions member, please review these terms and conditions.
1 Introduction
1.1 The company acts as an agent between members and any company or organisation wishing to employ our services. The website provides services to you, the member, as well as organisations.
1.2 The website is wholly operated and controlled from within the UK.
1.3 As a member your contract with the company will be subject to these terms and conditions.
1.4 We make no guarantee of finding you work through Fit Body Promotions.
2 Registration & Membership
2.1 Please read these terms and conditions agreement carefully. The agreement sets out the terms under which Fit Body Promotions services are provided to you by us through the Fit Body Promotions website. By applying to register with the website you become a member of the service, and you agree to be bound by the terms and conditions of this agreement for as long as you continue to be a member. If you do not agree to the terms, please do not register. Fit Body Promotions members are allowed to have only one single account on the website.
2.2 In order to become a member featured on the website you must be at least 18 years of age.
2.3 By registering to become a Fit Body Promotions member and/or using the website, you agree to the terms of the website's services, conditions, notices and guidelines contained in this Terms and Conditions Agreement. This Agreement is subject to be changed or modified at any time by posting the modified or changed terms on our site. The modified terms shall be automatically effective immediately after they are initially posted on our site. This Agreement may not otherwise be amended except in a writing signed by both parties. This Agreement was last revised on 17/06/10.
2.4 We reserve the right at any time to:
(a) change the terms and conditions of this agreement,
(b) change the site, including eliminating or discontinuing any content or feature of the site, or
(c) change any fees or charges for using the site.
2.5 To become member you must register with us and the registration must be approved and accepted by us. Submitting a registration does not automatically include you as a member. When and if you register to become a member, you agree to provide accurate, current and complete information about yourself as prompted by our registration form, and to maintain and update your member profile information to keep it accurate, current and complete. You agree that we may rely on your registration data as accurate, current and complete. You acknowledge that if your registration data is untrue, inaccurate, not current or incomplete in any respect, we reserve the right to terminate this agreement and your use of the site.
2.6 Using any services provided by the company signifies that you agree to, and will abide by, these terms and conditions in addition to any further terms and conditions in reference to a particular job description.
2.7 Acceptance of a job offered by the company, whether verbally or electronically, confirms agreement to all terms and conditions of that job and on the website. Payment of all jobs will only be made on fulfilment of the said job. Fulfilment requires completing all specified times and dates of the job, turning up to the job on time, not leaving the job until the specified time, not taking days off due to illness, playing the role you were booked to do, turning up in and maintaining a good appearance and wearing the agreed attire for the job. Breaking these terms and conditions may result in no payment being made at all, or at the discretion of the company your payment being reduced accordingly.
2.8 Payment and appropriate remuneration for a job will be agreed prior to acceptance and will be made within 30 days after the job
2.9 Either you or the company may terminate your membership at any time, for any reason, effective within 10 working days upon sending written notice to the other party. Any membership fees paid are non-refundable. We reserve the right to immediately suspend or terminate your access to the service, without notice, upon any breach of this agreement by you which is brought to our attention.
2.10 As a member, you agree that:
(a) You will use the service in a manner consistent with any and all applicable laws and regulations. Fit Body Promotions reserves the right, but has no obligation, to reject any profile or photograph or image or video that does not comply with these prohibitions.
(b) You will not impersonate any person or entity.
(c) You will not harvest or collect personal information about other members whether or not for commercial purposes, without their express consent.
(d) You will not use any robot, spider, site search/retrieval application, or other manual or automatic device or process to retrieve, index, "data mine", or in any way reproduce or circumvent the navigational structure or presentation of the site or its contents.
(e) You will not submit, distribute or reproduce in any way any copyrighted material, trademarks, or other proprietary information without obtaining the prior consent of the owner of such proprietary rights.
(f) You will not "frame" or "mirror" any part of the site, without our prior written authorization. You also shall not use metatags or code or other devices containing any reference to Fit Body Promotions or the service or the site in order to direct any person to any other web site for any purpose.
(g) We reserve the right to immediately suspend or terminate your access to the service, without notice, upon any breach of this agreement by you which is brought to our attention.
3 Obligations
3.1 The company will endeavour to:
(a) Provide opportunities for part-time work.
(b) Provide a platform for clients, companies and relevant organisations, the possibility of communication with each other.
(c) Take reasonable steps to ensure that the website is a secure and safe site to store your information.
(d) Pay promptly for work carried out by members, and certainly no later than 30 days following the work.
(e) Abide by all relevant statutory requirements
3.2 Members will:
(a) Agree not to use the website for any illegal purpose and to use it in accordance with relevant laws.
(b) Supply only accurate information which is not offensive, obscene or of a defamatory nature.
(c) Not cause damage to the website in any way.
(d) Not attempt to breach unauthorised parts of the website.
(e) Abide by the Data Protection Act that relates to you.
(f) Supply up to date, relevant information; this is needed by us to help give you a greater chance of sustaining work through Fit Body Promotions.
(g) Abide by all our rules and regulations both before and after accepting a job via the company with a third party.
(h) Observe our Privacy Policy (LINK) as specified on our website from time to time
(i) Not use any part of our website for the purpose of transmitting or posting viruses
4 Warranty and Liability
4.1 Content, which is supplied by third parties directly is provided on “as is” and “as available” basis. No warranties of any kind, express, implied or statutory, in any communication with the company or its representatives, or otherwise with respect to the service or the site. The company specifically disclaims any implied warranties of merchantability, fitness for a particular purpose or non infringement. The company does not warrant that your use of the service or the site will be secure, uninterrupted, always available or error-free, or will meet your requirements, or that any defects in the service or the site will be corrected.
4.2 The company disclaims all liability, regardless of the form of action, for the acts or omissions of other members or users (including unauthorized users, or "hackers") of the service. Certain jurisdictions limit the applicability of warranty disclaimers and limitations of liability so the above disclaimers of warranty and limitations of liability may not apply to you.
4.3 We will take all reasonable steps to ensure that information supplied by third parties to the company is accurate. We cannot accept liability for reliance on information supplied by third parties.
4.4 The company makes no warranties in relation to accuracy of information on our website. We assume no liability for any loss/damage caused as a result of any computer virus or other technical fault.
4.5 We may contact you with information about product/services that may interest you or help enhance your experience with us.
4.6 In no event will the company be liable for any damage whatsoever (including, without limitation, damages relating to lost revenues or profits, lost data, work stoppage, computer failure or malfunction) resulting from, or in any way related, to the use of any materials posted on any other web site to which a link is provided.
5 Proprietary Rights and Confidentiality

The services and the site contain the copyrighted material, trademarks and other proprietary information and software of Fit Body Promotions and its licensors. In addition, other members may submit copyrighted information, which has copyright protection whether or not it is identified as copyrighted. 5.2 By submitting information or content to the company, you automatically grant, and you represent and warrant that you have the right to grant, to the company an irrevocable, perpetual, non-exclusive, fully-paid, worldwide license to use, copy, perform, display and distribute such information and content and to prepare derivative works of, or incorporate into other works, such information and content, and to grant and authorize sublicenses of the foregoing.
5.3 We will respect your personal information and undertake to comply with all applicable data protection legislation Worldwide and other jurisdictions in which we offer the service, subject to the privacy policy of Fit Body Promotions.
5.4 The personal information (including sensitive personal information) you provide to us will be stored on computer. You consent to us using this information to build up a profile of interests, preferences and browsing patterns and to allow you to participate in the Fit Body Promotions service. All members also agree to uphold and maintain our privacy policy and to the terms and conditions thereof.
6 Copyright Policy and Complaints
6.1 We respect the intellectual property of others, and we ask our members to do the same. If you believe that a copy of your work is available on the site without your consent or that a copyright infringement has otherwise occurred, please supply us with the following information:
(a) a description of the copyrighted work that you claim has been infringed,
(b) details of where the infringing material is located on the site,
(c) your telephone number and email address,
(d) a statement by you that you believe in good faith that the use of the work on the site is not authorized by the copyright owner or any person entitled to act on their behalf or by law.

7 General
7.1 This agreement with you, set out in these member terms and conditions, is governed by universal laws and you and we submit to the non-exclusive jurisdiction of the universal courts in the event of any dispute regarding these terms or the service or the site or any matter related thereto. This agreement shall not be governed by the United Nations convention on contracts for the international sale of goods, the application of which is hereby expressly excluded.
7.2 This agreement, accepted by you upon submitting registration as a member or by using the website, contains the entire agreement between you and Fit Body Promotions regarding the service and the site, including the Fit Body Promotions privacy policy. In the event of any conflict between the privacy policy and this agreement, this agreement shall control. Unless otherwise explicitly stated, the terms will survive termination of your membership to the service. This agreement shall terminate immediately and without notice if you breach any of the terms, subject to the survival of all rights and reservations of Fit Body Promotions. If any provision of this agreement is held invalid, the remainder of this agreement shall continue in full force and effect.
7.3 The member certifies that the member has read and agrees to be bound by these Fit Body Promotions member terms and conditions.
